Terms and Conditions


We inform the users of www.grupoavantech.com about the following Terms and Conditions of Use and Privacy, which apply to them simply by using or accessing any of the pages that make up the "Portal," thus we understand that they accept and agree to comply with them. If you do not agree with the Terms and Conditions of Use and Privacy, you should refrain from accessing or using the Portal.
Enertec Integritas, S.A. de C.V. reserves the right to modify the content of the Portal at its discretion at any time, without prior notice. We also reserve the right to refuse, modify, or discontinue the Service (or any part or content of it) without prior notice at any time. The User is understood as anyone who accesses the Portal through a computer and/or communication device and agrees not to use devices, software, or any other means to interfere with the activities and/or operations of the Portal or the databases and/or information contained therein.
The headings used in this agreement are included only for reading convenience and will not limit or affect these Terms and Conditions.

General Conditions
The access or use of the Portal expresses the full and unconditional adhesion of the User to these Terms and Conditions of Use and Privacy. Through the Portal (http://grupoavantech.com), the User (understood as anyone who accesses the Portal) will use various services, products, and/or content (hereinafter referred to as "Services, Products, and/or Content") made available to Users by the members of Enertec Integritas, S.A. de C.V. and/or its subsidiaries, parent companies, related parties, and affiliates (hereinafter referred to as "Grupo Avantech"), and/or by third-party providers of Services, Products, and/or Content. Grupo Avantech shall have the right to deny, restrict, or condition the User's access to the Pages, in whole or in part, at its sole discretion, as well as to modify the Services, Products, and Content of the Pages at any time without prior notice.
The User acknowledges that not all Services, Products, and/or Content are available in all geographic areas and that some Services, Products, and/or Content may only be used after prior subscription, activation, or registration by the User and/or upon payment of a fee, as indicated in the contracting conditions established in the respective documentation. Grupo Avantech does not guarantee the availability and continuity of the operation of the Pages or the Portal and the Services, Products, and/or Content, nor the utility of the Portal or the Services, Products, and/or Content concerning any specific activity, regardless of the access method used by the User, including mobile telephony. Grupo Avantech shall not be liable for any damage or loss of any nature that may be caused due to the lack of availability or continuity of operation of the Page and/or the Services, Products, and/or Content.
Intellectual Property
The intellectual property rights concerning the Services, Products, and/or Content and the distinctive signs and domains of the Portal, as well as the rights of use and exploitation thereof, including their disclosure, publication, reproduction, distribution, and transformation, are the exclusive property of Grupo Avantech or its clients or subsidiaries. The User does not acquire any intellectual property rights by simply using the Services, Products, and/or Content of the Page, and such use shall not be considered as authorization or license to use the Services, Products, and/or Content for purposes other than those contemplated in these Terms and Conditions of Use and Privacy and the respective contracts.

Third-Party Intellectual Property
The User agrees that the provisions set forth in the previous paragraph regarding the ownership of the rights of Grupo Avantech also apply to third-party rights concerning the Services, Products, and/or Content of the Pages, domains, or information presented or linked to the Portal.

Permitted Uses
The use of the Services, Products, and/or Content of the Portal is the exclusive responsibility of the User, who in any case must use them according to the functionalities allowed on the Page and the uses authorized in these Terms and Conditions of Use and Privacy. Therefore, the User undertakes to use them in such a way that does not violate the rules of use and coexistence on the Internet, the laws of the United Mexican States, the legislation in force in the country where the User is located when using them, good customs, human dignity, and the rights of third parties. The Portal is for the individual use of the User, and therefore, they may not commercialize the Services, Products, and/or Content in any way.

Restrictions
The User does not have the right to place hyperlinks to and from the Portal, nor the right to place or use the Services, Products, and/or Content of the Page on their own or third-party sites without prior written authorization from Grupo
Avantech. Similarly, the User shall not have the right to limit or prevent any other User from using the Portal. The User may not use our products for any illegal or unauthorized purpose, nor may they, in the use of the Service, violate the laws of their jurisdiction (including but not limited to copyright and industrial property laws). The User shall not transmit any worms or viruses or any code of a destructive nature.

Service, Product, or Content Modifications and Prices
Grupo Avantech, at its sole discretion, may change any of the Services, Products, and/or Content within the Portal at any time. We reserve the right to modify or discontinue the Service, Products, and/or Content without prior notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the Service, Products, and/or Content.

Quality of Services, Products, and/or Content
Neither Grupo Avantech nor its suppliers or business partners shall be liable for any damage or harm suffered by the User as a result of inaccuracies, queries made, advice, typographical errors, and changes or improvements made periodically to the Services, Products, and/or Content. Recommendations and advice obtained through the Portal are of a general nature and should not be considered when making personal or professional decisions. For this, a professional advisor should be consulted according to the User's specific needs.

Third-Party Linked Goods and Services
The fact that information is offered on the Portal or other linked or related sites does not imply the recommendation, guarantee, sponsorship, or approval by Grupo Avantech regarding such information, goods, and/or services. The availability of goods and/or services offered by third parties or by linked or related sites is not the responsibility of Grupo Avantech. In view of the foregoing, Grupo Avantech shall not be liable to any authority of any nature for any matter related to the sale, consumption, distribution, delivery, availability, or provision of any of the goods and/or services offered by third parties or by linked or related sites through the Portal.

Concerning the Services, Products, and/or Content provided by third parties within or through links on the Page (such as links, banners, and buttons), Grupo Avantech limits itself exclusively, for the User's convenience, to: (i) inform the User about them, and (ii) provide a means to contact the User with suppliers or sellers. The products and/or services marketed within the Portal and/or on third-party linked sites are supplied by merchants independent of Grupo Avantech. All advice, statements, information, and content of third-party linked pages or within the Page represent the opinions and judgments of such third parties; consequently, Grupo Avantech shall not be liable for any damage or harm suffered by the User as a result thereof.
Confidentiality
Grupo Avantech is committed to maintaining the confidentiality of the information received from the User, which has such a character in accordance with applicable legal provisions in the United Mexican States. Grupo Avantech assumes no obligation to maintain confidential any other information provided by the User, whether when registering on the Portal or at any other time thereafter, including information provided by the User through newsletters, bulletin boards, or online chat; as well as information obtained by Grupo Avantech through Cookies described in the related paragraph.

Changes to the Terms and Conditions
The User may review the most recent version of the Terms and Conditions at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes on our website. It is the User's responsibility to check our website periodically for changes. Your continued use of our website or the Service or access to any of these after any changes to these Terms of Service are posted constitutes acceptance of those changes.

Cookies
The User who accesses the Page agrees to receive files transmitted by Grupo Avantech's servers. "Cookie" means a data file stored on the User's hard drive when they access the Page. These files may contain information such as the User's ID or information to track the pages the User has visited. A Cookie cannot read the data or information on the User's hard drive or read Cookies created by other sites or pages.

At all times, the User is solely and ultimately responsible for keeping their access keys secret, which allows them to access certain Services, Products, and Content of the Portal, as well as third-party pages.

GRUPO AVANTECH reserves the right to modify the Terms and Conditions of Use and Privacy at any time. Consequently, the User must carefully read the Terms and Conditions of Use and Privacy each time they intend to use the Portal. Certain Services, Products, and/or Content offered to Users on and/or through the Page are subject to their own specific conditions
that replace, supplement, and/or modify the Terms and Conditions of Use and Privacy (hereinafter referred to as the "Particular Conditions"). Accordingly, the User must also carefully read the corresponding Particular Conditions before accessing any of the Services and Content. In accordance with applicable law, certain services will require the installation of protection tools for the information requested, and service will be denied if the required installation is not accepted.

Applicable Laws and Jurisdiction
For the interpretation, compliance, and execution of these Terms and Conditions of Use and Privacy, the User agrees that the Federal laws of the United Mexican States and the competent courts of Mexico City shall apply, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles or for any other reason.

Severability
In the event that any provision of these Terms and Conditions is determined to be illegal, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms and Conditions, without affecting the validity and enforceability of the remaining provisions.

Recission
The obligations and responsibilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If, in our judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly we may deny you access to our Services, Products, and/or Content (or any part thereof).

Entire Agreement
The fact that we do not exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
